The charge stems from an incident in July 2016 at the Club Car, a restaurant and bar on Nantucket.

An attorney for Spacey, Juliane Balliro, had argued that Spacey's presence at his arraignment would only "heighten prejudicial media interest in the case" and increase the risk of contaminating the jury pool. This request was denied. He faces a single charge of indecent assault and battery, which carries a maximum sentence of five years in prison. He said he chose to come forward because he didn't want something similar to happen to anyone else. Spacey has had his appearance at this hearing waived; however, he must remain available on this day.

Since Rapp came forward with his allegations, several other sexual misconduct allegations have emerged against Spacey.
